Father in deadly shooting along Doniphan Drive followed victim suspecting he damaged mailbox

A father and his two sons remain jailed for the deadly shooting that killed a 32-year-old father.

The arrest affidavit for the man whose handgun was fired in the shooting revealed what led up to the encounter in middle of a busy roadway in El Paso's Upper Valley Tuesday.

Raul Alberto Orozco, 53, was arrested and charged with murder.

Police investigators learned Raul had followed Marcos Fino Jr. in his vehicle when Fino Jr. drove past Raul's home along Montoya Road near Oleaster Drive.

According to Raul, Fino Jr. had passed by his home in a Chrysler 300 several times that day.

Raul believed Fino Jr.'s vehicle may have been the same vehicle that had struck his mailbox a month ago.

Raul followed the Chrysler 300 to Doniphan Drive to get the vehicle's license plate number, stated the affidavit.

During the pursuit, Raul called his sons, Jose Alberto and Cristian Bradley, to notify them about his whereabouts.

Fino Jr. reportedly applied his breaks and caused Raul's truck to slam into the Chrysler 300.

Fino Jr. got out and approached Raul, according to the affidavit.

By that time, Jose Alberto and Cristian Bradley arrived at the site, and blocked the Chrysler 300.

Jose Alberto reportedly placed his vehicle in front of Fino Jr.'s car.

A verbal altercation ensued between the Orozco's, Fino Jr. and a passenger who was riding with Fino Jr.

Jose Alberto admitted when he arrived to the scene he "chambered a live cartridge into his firearm and holstered the handgun, inside his waistband, which was in plain view." stated the affidavit.

Jose Alberto told police investigators he hid not know what was going to happen and needed to be ready.

Jose Alberto said he and his brother confronted Fino Jr. and a passenger, who was with Fino Jr., and a fight ensued.

According to the arrest affidavit, Jose Alberto wrestled with Fino Jr. and Cristian Bradley wrestled with Fino Jr.'s passenger.

Jose Alberto said when he was wrestling Fino Jr., Fino Jr. reached for his handgun.

He explained as he wrestled for control of the handgun the gun fired, striking Fino Jr.

Jose Alberto and his brother, Cristian Bradley, left the scene and drove to their home nearby on Montoya Road, stated the document.

During the altercation, Fino Jr's 10-year-old son was in the back seat of the Chrysler 300.

Police determined the handgun was fired twice, striking Fino Jr.

Cristian Bradley told investigators when they returned home, he called police.

Responding police officers were flagged down along Doniphan by people standing outside the Chrysler 300.

Fino Jr. was in the vehicle and needed medical attention.

He was taken to a hospital by ambulance where he was later pronounced dead.

Jose Alberto's bond was set at $1 million.

According to a report in 2019, Jose Alberto was arrested in connection to a robbery in east El Paso.

He was charged with possession of marijuana, possession of a controlled substance and unlawful carrying of a firearm.

Jose Alberto is expected for his bond hearing Friday.

Raul and Cristian Bradley's bonds were set at $500,000.
